Terms and Conditions of Sale

Article 1 — Seller identity
These general terms and conditions of sale are entered into between:
On the one hand, BEAUGRAIN, a SAS with share capital of €60,000, registered with the Créteil Trade and Companies Register under number 509 286 837, with its registered office at Fleur 1, 19 rue de Saint Pol de Léon, 94550 Chevilly-Larue, France. Intra-EU VAT number: FR40509286837. E-mail: contact@beaugrain.com. Hereinafter referred to as "the Seller".
On the other hand, any natural or legal person wishing to make a purchase via the website beaugrain.com, hereinafter referred to as "the Customer".
Article 2 — Purpose
These general terms and conditions are intended to define the rights and obligations of the parties in connection with the online sale of fresh food products (fruits, vegetables, meats and derived products) offered by the Seller on beaugrain.com.
Article 3 — Acceptance
Any order placed on beaugrain.com implies full and unreserved acceptance of these terms and conditions, to the exclusion of any other document. The Customer declares having read these terms before placing the order.
Article 4 — Products
The products offered for sale are described and presented with the greatest possible accuracy. Photographs and descriptions of products are provided for information purposes only. The Seller cannot be held liable for slight variations between the illustration and the delivered product (size, hue, seasonality).
Products are offered subject to availability. In the event of unavailability after the order has been placed, the Customer will be informed by e-mail and may request a refund of the unavailable portion or a credit note.
Article 5 — Prices
Prices are stated in euros, all taxes included (French VAT at the current rate, i.e. 5.5% for food products). Delivery charges are indicated separately before order validation.
The Seller reserves the right to modify prices at any time; products will however be invoiced based on the rates in force at the time of order validation.
Article 6 — Order
The Customer places the order online on beaugrain.com following these steps:
- Product selection and addition to cart
- Cart review
- Entry of details and delivery address
- Choice of payment method
- Validation and payment
A confirmation e-mail is sent to the Customer upon completion of the order. The sale is definitively concluded upon receipt of payment.
Article 7 — Payment
Payment is made online by credit card (Visa, Mastercard, American Express) or any other means offered on the website. Transactions are secured by our payment provider Shopify Payments.
No banking data is stored by the Seller.
Article 8 — Delivery
Delivery terms, deadlines, areas served and charges are detailed on the Shipping policy page.
Deliveries are operated by Chronofresh in a controlled cold chain. The standard delivery time is the next day (J+1) before 1 PM for any order placed between Sunday and Thursday. No delivery on Mondays.
In case of a delivery delay attributable to the carrier, the Customer is invited to contact the Seller at contact@beaugrain.com.
Article 9 — Right of withdrawal
In accordance with article L.221-28 3° of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods liable to deteriorate or expire rapidly.
Accordingly, fresh food products sold on beaugrain.com do not qualify for the right of withdrawal. Any validated order is firm and final.
Article 10 — Conformity and claims
Upon receipt of the order, the Customer is invited to check the conformity and condition of the delivered products. In case of a missing, damaged or non-conforming product, the Customer must inform the Seller within 24 hours of delivery, by e-mail to contact@beaugrain.com, attaching photographs and the order number.
The Seller will, depending on the case, refund, replace or issue a credit note.
Article 11 — Legal warranties
The Customer benefits, automatically and without additional payment, regardless of the right of withdrawal:
- from the legal warranty of conformity (articles L.217-3 et seq. of the French Consumer Code), for products that are apparently defective, damaged or do not match the order;
- from the legal warranty against hidden defects (articles 1641 to 1649 of the French Civil Code), provided the defect existed prior to delivery and was not apparent at that date.
Article 12 — Consumer mediation
In accordance with article L.612-1 of the French Consumer Code, the Customer has the option, in the event of a dispute with the Seller, of using a consumer mediator free of charge.
The Customer may also access the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
Article 13 — Personal data
Personal data collected as part of the order is processed in accordance with our Privacy policy.
Article 14 — Applicable law and jurisdiction
These general terms and conditions of sale are governed by French law. In the event of a dispute, and after any attempt at amicable resolution has failed, the competent courts shall be those of the jurisdiction of the Seller's registered office, subject to the legal provisions protecting consumers.
